Conditions of Use for Job Seekers (Advertisers see below)
In these terms and conditions:
"site" means the internet website "adage.com.au" and includes the products and services contained therein; "adage" means Adage Pty Ltd (ACN 119 397 429) and in particular in its capacity as owner and controller of the site; and "you" and "job seekers" means the person or entity using the products and services on the site.
1. no liability to users of this site
adage gives no warranty in relation to the service provided or supplied. Under no circumstances is adage or any of its carriers or suppliers liable or responsible in any way to you or any other person for any loss, damages, costs, expenses or other claims (including consequential damages and loss of profits or loss of revenues), howsoever caused, including as a result, direct or indirect of any defect, deficiency or discrepancy in the service including its form, content and timeliness of delivery, including, without limitations, for and in relation to any of the following:
(a) Any service supplied to you.
(b) Any delay in supply of the service.
(c) Any failure to supply the service.
(d) Any technical or non-technical failure.
(e) Any content or information accessed via the service with or without your authorisation.
The Australian Trade Practices Act 1974 and certain State and Territory legislation may imply certain conditions and warranties into the Agreement. To the extent permitted by law those conditions or warranties are expressly excluded. Where they cannot be excluded, adage’s liability (if any) arising from the breach of those conditions and warranties is limited, in adage’s discretion to the supply of the services again or cost of resupplying the services again.
2. intellectual property
You acknowledge that all intellectual property contained on this site is and remains at all times the property of adage or the advertisers identified on the site. You agree not to use the information or other material on this site for any unlawful purpose or in any manner that would, in any way, infringe our intellectual property rights or those of the advertisers.
3. no guarantee of the jobs advertised or of vacancies
Whilst adage strives to ensure that all jobs advertised are genuine vacancies and are available throughout the time they are posted on the site, adage does not guarantee the availability of any job advertised on this site and will not be liable to you if the listed vacancy is not a genuine vacancy or is filled by the advertiser at any time.
4. no responsibility for jobs and advertisements posted
adage accepts no responsibility for the content or accuracy of job advertisements on this site and does not in any way recommend or endorse any jobs advertised on this site. adage will not be liable to you for the quality or safety of jobs advertised.
5. you agree to provide accurate information
You agree and acknowledge that all information you provide on this site is true and accurate and that no information and omissions given or made by you are intended to mislead or deceive any person or are likely to have that effect.
6. no warranty for site
Whilst adage takes great care to ensure the service provided on the site is of the highest standard, we give no warranties to users as to the reliability or availability of the site, that the site will be free from viruses and other damaging programmes or code, whether replicating or otherwise, or that use of the site will not result in damage or loss to your hardware, software or any data stored on it. You agree that you are solely responsible for providing any software and other devices necessary to effectively deal with viruses and other damaging or destructive programmes and code that may affect your data or other property.
7. no guarantee to protect your information
adage accepts no liability for any loss or damage incurred by you as a result of information provided to us by you being copied, intercepted or otherwise unlawfully dealt with by unauthorised persons or entities, whether in transition to or from the site or whilst stored on the site.
8. no liability for loss or misuse of passwords and login names
You acknowledge that you are solely responsible for the maintenance, use and security of your password or login name and that adage will not be liable for any loss or damage you may incur as a result of the loss or misuse of either of them. You must maintain the confidentiality of your password and account, and are responsible for all activities that occur with your account. Where the current account details and password are provided, adage is entitled to assume that the access is by you, or authorised by you, and you indemnify adage completely against any claim of loss or damage that results from wrongful, fraudulent or other access (using the correct account details and password) to your account.
9. no endorsement of other sites sponsored or advertised
As a further service to you and others, adage may provide links to other sites or allow sponsors or other persons to display their logos or otherwise advertise their products or services on the site. Such action by adage does not imply either directly or indirectly that adage endorses such sites, products, services or entities in any way. adage has no control over such sites, products, services or entities and will not be liable for any loss or damage incurred by you as a result of, or in connection with, your use of such sites, products or services.
10. terms and conditions of draws
From time to time Adage will run a draw to promote job seeker registration. Entry is free to job seekers and prizes will vary. To win you must agree to have your name published on the Adage Web site and, if you are a resident of the state of Victoria, in a Victorian newspaper. If you do not agree to the publication of your name you must notify Adage in writing within ten days. You will then forfeit your prize and a redraw will be held immediately. Adage employees and their family members, Adage partners, sponsors and clients, agents, suppliers, and their employees and immediate families are not eligible to win any Adage draw. When Adage runs a draw the job seeker is automatically entered during the duration of the draw when they register as a job seeker with Adage. The draw is a single selection for each prize and is performed at 5 pm on the date of the close of the draw at Suite 1505, Tower 1, 520 Oxford Street, Bondi Junction, NSW 2022. Winners to be notified in writing by email. Any unclaimed prizes after 90 days will be forfeited and a new winner will be selected by an unclaimed prize draw conducted within 95 days of the original draw and will be subject to any written directions given under state regulations. Further details of Adage draws such as detail and value of all prizes, start date, end date and winner notification date are displayed on the registration page for the duration of the draw.
11. use of your information
You acknowledge and agree that adage may use any information (other than your personal information) and intellectual property you provide to us through the site at any time and for any reason. In handling your information, adage will comply with the adage privacy policy.
12. adherence to terms and conditions
adage may change these terms and conditions at any time. All changes will become effective immediately they are published on this site, unless stated otherwise, and you agree to be bound by these terms and conditions as amended by us from time to time.
13. governing law
These terms and conditions shall be governed by the laws of New South Wales You agree to submit to the exclusive jurisdiction of the courts of New South Wales.
14. severance of unenforceable terms
Any part or parts of these terms and conditions which may be held invalid shall be severed from the remainder of the terms and conditions which shall continue to be valid and enforceable.
15. termination of the agreement
If the agreement entered into is terminated for any reason whatsoever, such of these terms and conditions which shall be capable of surviving such termination shall continue to be valid and enforceable.

6. no liability for loss or misuse of passwords and login names
You acknowledge that you are solely responsible for the maintenance, use and security of your password or login name and that adage will not be liable for any loss or damage you may incur as a result of the loss or misuse of either of them. . You acknowledge and agree that adage may use any information and intellectual property you provide to us. If you provide your logo and company information in our employer directory, you give Adage permission to use these details anywhere else in the site from time to time to further promote activity on Adage.
9. adherence to terms and conditions
All changes will become effective immediately they are published on this site, unless stated otherwise. adage may change these terms and conditions at any time. You agree to be bound by these terms and conditions as amended by us from time to time.
10. adherence to relevant laws
You agree to ensure that all advertisements placed comply with all relevant State, Territory and Commonwealth laws and to treat all personal information collected by you as a result of the use of the site in compliance with the National Privacy Principles set out in the Privacy Amendment (Private Sector) Act 2000. You further agree not to use any information collected from the site to send unsolicited emails to any one or more job seekers. adage reserves the right to refuse to accept, or to remove previously accepted, advertisements which breach, or appear to breach, any State, Territory and Commonwealth law or for any other reason whatsoever.
11. indemnity for adage
You agree to indemnify and keep indemnified adage and its officers, employees and agents against all costs, damage or loss incurred as a result of claims, demands or actions brought by any person or entity in respect of an actual or alleged breach of any law (and including a breach of these terms and conditions) or other rights and as a result of your advertising on the site.
12. governing law
These terms and conditions shall be governed by the laws of New South Wales. Advertisers agree to submit to the exclusive jurisdiction of the courts of New South Wales.

Any part or parts of these terms and conditions which may be held invalid shall be severed from the remainder of the terms and conditions which shall continue to be valid and enforceable.

15. refund policy
Refunds on credit card payments will be made at the discretion of management.
16. security
The site supports secured sockets layer (SSL) based transactions from a browser to the lvl of at least 128 bit or greater.
17. delivery policy
After payment is received the user is taken back to their main account page where they will be able to view details of their purchased product. An invoice will be mailed immediately in PDF format and will be structured according to standard invoicing requirements.

At adage we respect the privacy of our clients, customers and all visitors to our site ("users") and manage information in line with Commonwealth and State privacy laws.
Personal Information Information, including personal information, about users may be collected from our site for the purposes of providing quality job board and other services to users. If a user does not provide the requested personal information they will not be able to use the site for transactions or communications.
Use of Personal Information adage may disclose personal information collected from users to potential or actual employers and clients of adage for the purposes of securing employment. Information may also be provided to third parties involved in the employment process e.g. adage insurers, registration bodies etc. Whilst we request that such persons comply with all relevant laws relating to your personal information, adage cannot take responsibility for the manner in which these persons deal with the information supplied to them. adage will not disclose information collected from users for any other purpose unless with the user's consent or in other circumstances where use is permitted under the Privacy Act. adage may from time to time contact users of adage services to participate in feedback, surveys or to receive general information updates. The opportunity to opt out of any of these services will be provided at all times.
Security adage takes all reasonable steps to ensure the security of personal information provided. Information is held in secure computer storage systems and paper-based filing systems.
Accessing and Altering Records of Personal Information Under the Privacy Act users are entitled to request access to records containing their personal information in line with the provisions of the Act. adage will endeavour to respond to requests in a timely manner and where information is copied or provided will charge a fee to cover the reasonable costs of supplying this information. adage reserves the right to refuse access where denying access is required or authorised by law.
Information Accuracy As site users supply the vast majority of information held by adage, accuracy of information supplied is primarily the responsibility of the user. Users are responsible for keeping their electronic profiles stored in the adage site, up to date. Should a user advise us that information other than that held in the self-service area of the site is incorrect, adage will take all reasonable steps to ensure the data is corrected in a timely manner.
